Privacy Policy of Somers Isles Shipping Ltd.

1. Introduction

This Privacy Policy outlines how Somers Isles Shipping Ltd. (“SISL”, "we", "us", or "our") collects, uses, and protects personal information in compliance with Bermuda's Personal Information Protection Act (PIPA).

The Policy will be maintained by SISL’s Privacy Officer (PO) and will be reviewed by SISL’s Board of Directors annually.

2. Information We Collect 

We may collect the following types of personal information:

  • Identification Information: Name, address, phone number, email address, date of birth and any other information you provide. We do not collect data that is defined as sensitive personal information under Bermuda’s PIPA.

  • We process your personal information because you want to use the shipping service we provide. To be able to provide this service we need this personal information to communicate with you and we are required by the authorities in Bermuda and the USA to provide them with your name and address if you are either the shipper or the consignee of a shipment you requested us to provide.

  • Technical Data: IP address, browser type, and other related technical information if you visit SISL’s website is NOT being collected or used by SISL.

 

Purpose of Processing Personal Information

We collect and process your personal information for the following purposes:

  • To provide and manage our services.

  • To communicate with you, including responding to inquiries.

  • To comply with legal obligations.

 

Legal Basis for Processing Personal Information

We process your personal information based on the following legal grounds:

  • You have given us explicit permission (consent) to process your information.

  • Processing is necessary to perform the service you have purchased from us or intend to purchase from us.

  • We are required to provide your personal data with legal or regulatory authorities in Bermuda and the USA to be allowed to provide our service to you.

 

Sharing Your Information

As SISL does not have any employees, it outsources services to North Florida Shipping Inc., Meyer Freight Ltd. and Container Ship Management Ltd. (CSM). We do not sell your personal information to third parties. We may share your information with:

  • Our General North American agent, North Florida Shipping Inc. (NFS), in the USA, who has adopted the same privacy policy as SISL and SISL has additional privacy clauses in its contract with NFS. NFS needs your personal information to be able to provide the service you wish us to provide to you.

    Meyer Freight Ltd., our Bermuda agent, has its own Privacy Policy that complies with Bermuda PIPA legislation and SISL has additional privacy policy clauses in its contract with Meyer Freight Ltd.

    CSM, our Managing agent in Bermuda, also has its own Bermuda PIPA compliant privacy policy and SISL has additional privacy policy clauses in its contract with CSM.

  • Legal Authorities in Bermuda and the USA. International shipping requires us to provide your personal information to the legal authorities if we carry a shipment for you between these two countries.

  • Agent and legal authorities in any country if the destination of your shipment is not Bermuda or the USA for them communicate with you and decide if your shipment is allowed to enter that country.

  • Any information shared with third party businesses is only on a need-to-know basis and is done only if required to fulfill your service request from SISL and is subject to the privacy policy of that third party business.

 

Data Security

SISL and its agents implement appropriate technical and organizational measures to protect your personal information from unauthorized access, loss, or destruction.

Data transmission via the Internet, however, cannot be guaranteed to be secure and the Company cannot guarantee the security of personal information given to the Company via email.

3. Cookie Policy

As SISL’s website does not track any technical information a cookie policy does not exist.

 

4. Retention and Deletion

Personal Information is kept in electronic form on SISL owned systems to which the agents have access for seven years after they are destroyed. SISL does not keep hard copies of any personal information.

Financial information is kept in electronic format and for audit purposes sometimes in hard copy format. These physical records are kept in a locked cabinet with the Managing agent and are destroyed after seven years.

Customer information that is not Personal will be kept in electronic format for as long as the business requires after which they will be destroyed.

 

5. Your Rights

Under Bermuda's PIPA, you have the right to:                                   

  • The right to be informed.

    If we collect more data than contact details and address, we must inform the individual accordingly and explain the reason why this additional information is being collected

  • Access your personal information.

    An individual has the right to request to see or view their PI held by SISL. An individual can ask verbally or in writing and SISL will attempt to answer within 5 business days, but in any case, within the 45 days required by PIPA.

  • To erasure of your personal data.

An individual can request verbal or in writing to have their PI deleted by SISL.

This right is not absolute and only applies when there are no legal reasons for SISL to maintain the PI of the requesting individual. If it does apply SISL will erase all PI of the requesting individual.

  • Request correction of inaccurate information.

An individual has the right to have their PI corrected if it is inaccurate. SISL will also be obliged to inform any third party that received the PI of the corrected data.

  • To data portability.

An individual has the right to receive their PI they have provided to SISL in a structured, commonly used and machine-readable format. The individual can also request that SISL transmits this data directly to another data controller.

  • Withdraw consent at any time, where applicable.

6. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Any changes will be posted on this page with an updated effective date.

 

7. Complaint

We accept written complaints about:

  • How we collect data

  • How often and with whom we share data

  • Types and/or the amount of personal data we collect

  • Any other concerns you might have about how we manage data.
